HIRĀBAH (BEGAL) DALAM PERSPEKTIF HUKUM ISLAM (Studi Kasus di Kota Makassar)

Abstract

Abstract Currently, Begal, robbery in the street, is increasingly making the people of Makassar unable to do their activities well, as they always feel threatened by the street actions of the criminals.This research is aimed to find out the categorizations and forms of Begal in Makassar city from Islamic Law perspective and Islamic solution for this crime issue.This research is a descriptive qualitative field research usinga normative theologicaland juridicalapproach. There are two categories of the most common Begalcrime in the city of Makassar, i.e. a robbery with no murderanda robbery with roadblock without any seizures or murders. The Islamic solution to the problem of Begal is a preventive solution includingaqidah, worship, morality and amarma'rufnahyimungkar, as well as legal solutions (repressive) in the presence of had hirābah for the offender.Based on the perspective of Islamic law, for the first category of the robbery with the seizure of property without killing, the offender is threatened with the hadthat the offender’s right hand is cut off with his left foot.As for the second category which is the robbery by holding up and disrupting or frighteningon the way without robbing or killing, the offender is threatened with hadthat he is banished from his country of residence to another Islamic country or prison. The terms of this had imposed on the offenders in Makassar have been fulfilled.
