Abstract

The main idea is that the ruling on the constitutionality of the Statute of Catalonia (Estatut) sets out the limits but also the potential for developing the Autonomous State. Three conclusions may be drawn form the ruling. The first is the rejection of a confederal system, since the constitutional court proposes a correct interpretation of the elements of identity contained in the Estatut. Secondly, it clarifies the distribution of powers, rejecting the Estatut's attempt to shield regional competences, whilst accepting most of the powers. Finally, it strengthens autonomous community involvement in the exercise of the exclusive competence of the State.
