Menelisik Efektivitas Konstitusi : Independensi Lembaga KPK Pasca Putusan MK No.36 Tahun 2017 Sebagai Anomali Hukum

Abstract

Abstrak: Indonesia menganut sistem presidensial yang saling berkaitan dengan pemisahan kekuasaan (separation power) yang dapat dilihat dari trias politika yang dipisah  menjadi tiga kekuasaan yakni kekuasaan legislatif, kekuasaan eksekutif, dan kekuasaan yudikatif. Adanya pemisahan kekuasaan itu diharapkan mampu menciptakan pelaksanaan sistem Checks and balances dapat berjalan dengan baik. Dimana fungsi dari sistem tersebut untuk saling mengawasi antar lembaga satu dengan lainnya, agar tidak timbul terjadinya perilaku-perilaku yang hegemonic, tiranik, dan sentralisasi kekuasaan, akan tetapi saat ini ditemukan adanya tumpang tindih peraturan yang ada mengenai perubahan kedudukan Lembaga KPK menjadi Lembaga eksekutif di bawah naungan presiden. Hal tersebut berpotensi menimbulkan intervensi dari  kekuasaan berbagai  pihak.  Dengan  demikian Adanya pemberlakuan dari putusan MK No.36/puu-XV/2017, tentang diubahnya kedudukan lembaga KPK tersebut akan mengganggu independensi KPK dalam menjalankan tugasnya, atas perubahan kedudukan tersebut dikhawatirkan tidak akan mandiri dan bebas. Jadi, diperlukan adanya suatu perbaikan mendasar terkait dengan kedudukan lembaga KPK itu sendiri dimana lembaga KPK dijamin akan kebebasan sebagai lembaga independen tanpa adanya intervensi dari badan eksekutif diatasnya. Oleh karena itu, tujuan dari penelitian ini yaitu untuk mengetahui status quo konstitusi di Indonesia, dan independensi KPK akibat dari berlakunya putusan Mahkamah Konstitusi NO.36/puu-XV/2017. Dalam hal ini, penulis menggunakan metode penelitian hukum normatif serta menggunakan pendekatan perundang-undangan. The existence of this separation of powers is expected to be able to make the implementation of the checks and balances system run well. Where the function of the system is to supervise one another between institutions, so that hegemonic, tyrannical, and centralized power does not arise, but currently there is an overlapping of existing regulations regarding the change in the position of the KPK Institution to become an executive agency in under the auspices of the president. This has the potential to cause intervention from the power of various parties. Thus the enactment of the Constitutional Court decision No.36/puu-XV/2017, concerning changing the position of the KPK institution will interfere with the independence of the KPK in carrying out its duties, it is feared that this change in position will not be independent and free. So, there is a need for a fundamental improvement related to the position of the KPK institution itself where the KPK institution is guaranteed freedom as an independent institution without any intervention from the executive body above it. Therefore, the purpose of this research is to find out the status quo of the constitution in Indonesia, and the independence of the KPK as a result of the enactment of the Constitutional Court decision NO.36/puu-XV/2017.
