The principle or principle of buying and selling transactions in Islam (Sharia) is freedom of contract, with this principle, every Muslim is free to make, arrange or even change the form of a contract agreement as long as it does not violate the provisions of religion and positive law. The development of Islamic economics in Indonesia through both financial institutions and non-bank financial institutions is expected to be able to answer problems related to social and economic aspects of society. The writing method used in this study is normative juridical by collecting secondary data obtained from legislation, books, scientific journals, and electronic media. Islamic buying and selling transactions (sharia) have conditions and harmony in buying and selling, which includes 4 things, namely: there must be a akid (people who make a contract), ma'qud alayhi (goods that are contracted) and shighat, which consists of consent ( offer) qabul (acceptance), and exchange value for substitute goods. It aims to find out whether the sale and purchase transaction is legitimate according to the view of Islamic law. So the prohibition on transactions based on Sharia law can be avoided. Keywords: Principles, Freedom of Contract, Sharia A bstrak Asas atau prinsip transaksi jual beli dalam Islam (Syariah) ialah kebebasan berkontrak, dengan prinsip tersebut, setiap orang muslim bebas membuat, mengatur atau bahkan merubah bentuk akad perjanjian selama tidak melanggar ketentuan agama dan hukum positif. Perkembangan ekonomi syariah di Indonesia baik melalui lembaga keuangan dan lembaga keuangan non bank diharapkan mampu menjawab permasalahan terkait aspek sosial dan ekonomi masyarakat. Metode penulisan yang digunakan dalam penelitian ini adalah yuridis normatif dengan mengumpulkan data sekunder yang diperoleh dari Peraturan perundang-undangan, buku, jurnal ilmiah, dan media elektronik. Transaksi jual beli secara Islam (syariah) memiliki syarat dan rukun dalam jual beli, yaitu meliputi 4 hal, yaitu: harus adanya akid (orang yang melakukan akad), ma’qud alaihi (barang yang diakadkan) dan shighat, yang terdiri atas ijab (penawaran) qabul (penerimaan), dan nilai tukar pengganti barang. Hal ini bertujuan untuk megetahui sah atau tidaknya transaksi jual beli terebut menurut pandangan hukum Islam. Sehingga larangan dalam bertransaksi berdasarkan hukum Syariah dapat dihindari.
