Abstract

The paper analyzes administrative sanctions from the perspective of the enforcement of regulatory goals. Based on the theory of responsive regulation, it is argued that agencies should wield punitive and non-punitive tools to adapt to the regulated industry structure responding to the cooperation of regulated actors. Under this concept, the Chilean environmental penalty system is studied.
