Abstract

Post-conflict situations are not exempt from international law. This does not mean that the concept of jus post bellum can descriptively capture the existing regulation based on both general and specific rules. A normative case can however be made for the emergence of a generic obligation to reconstruct incumbent, at least in part, on the victors. This obligation would signal a shift from the Grotian paradigm in the international legal regulation of the post-war phase to a Kantian one. © The Author, 2013.
