ENTRE GRAÇA E DIREITOS: APONTAMENTOS SOBRE COMO ENTENDER AS PETIÇÕES NA AMÉRICA PORTUGUESA (SÉCULO XVIII)

Abstract

Resumo O objetivo do artigo é problematizar como entender as petições no universo português, por meio de uma discussão historiográfica sobre o “estado da arte” do tema nas últimas décadas, o que se justifica em razão de sua centralidade, bem como das principais mudanças ocorridas nos seus usos no século XVIII. Defende-se que estudar os caminhos que tais demandas tomavam é fundamental para compreender de modo mais sistemático o seu conjunto. Além disso, ampliam-se as possibilidades de pensá-las tanto a partir das múltiplas ações e grupos sociais, como do coevo reconhecimento acerca do que eram direitos. Sem a ambição de ser exaustivo, o texto pretende contribuir para a discussão das potencialidades da análise das petições, primeiramente, a partir de estudos atualmente considerados fundamentais para a compreensão das petições no mundo moderno, na interseção entre história e direito. Em seguida, o artigo concentra-se na experiência colonial da Ibero-América, em especial no caso dos tribunais e Conselhos, defendendo que há uma experiência conjunta entre ambas as monarquias que faz com que a historiografia para a América espanhola - bem mais extensa em relação à lusa - ilumine a compreensão da América portuguesa.Abstract The article aims to problematize how to understand petitions in the Portuguese universe through a historiographical discussion on the “state of the art” of the theme in recent decades, taking in account their centrality as well as the main changes that occurred in their uses in the eighteenth century. I will argue that studying the paths that the demands took is fundamental to understand more systematically their whole; also, to expand the possibilities of thinking about them both from the multiple actions and social groups as well as from the contemporary recognition of what rights were. Without seeking to be exhaustive, the text intends to contribute to the discussion of the potentialities of the analysis of petitions, firstly, from studies considered fundamental today for their understanding in the modern world, at the intersection between history and law. Next, the article focuses on the colonial experience of Iberian-America, especially in the case of the appeals courts and councils, supporting that there is a joint experience between both monarchies that makes the historiography for Spanish America - much more extensive compared with the Portuguese - illuminate the understanding of Portuguese America.
