Abstract

The wide array of activities which we refer to as deep sea mining are not governed by one universal framework. On the contrary, numerous legal instruments play a role and it is important to maintain a clear overview. This introduction offers a general explanation of the phenomenon of deep sea mining, runs through the multitude of legal instruments regulating these activities, touches upon the important difference between deep sea mining in the Area (beyond national jurisdiction and subject to international law) and on the continental shelf (within national jurisdiction and subject to national legislation of the coastal state)—while noting important nuances to this dichotomy—and explains the objective, methodology and structure of this monograph.
