Abstract

RESUMEN: El presente trabajo, realizado en el marco de una investi-gación sobre el origen histórico y metodológico del denominado Derecho Penal Constitucional, tiene como objetivo principal mostrar que el plan-teamiento teleológico constitucional de la Escuela de Bologna y la obra de su principal exponente, Franco Bricola, pueden constituir un antecedente directo de la tesis sobre el fundamento constitucional del Derecho penal democrático u orientación sustancial o teleológica sobre el rol de la Cons-titución en el sistema jurídico-penal.
