Abstract

The objective behind this research is to identify and characterize the problems that today affect the family judges in the course of fulfilling the different roles that law 19.968 assigns to them. For this purpose the author makes use of empirical research methods, specifically semi-structure interviews with Family Judges and Family Lawyers from three regions of the country. The interviews allowed to identify some of the problems that family judges face today, which take place during their interaction with other participants of the family justice system. Indeed, Family Judges face a series of obstacles when they have to interview children, deal with self-represented parties, while conducting hearings and in the course of their interaction with private lawyers. Later on the paper reflects on the main features of these difficulties and their possible causes.
