Considering the current situation of collaborative housing, rhis project aims to highlight the problems derived from its lack of a harmonized and suitable regulation. Thus, it deve!ops a review of the heterogeneous autonomic rules in the most demanded destinations by tourists; besides it studies the nature and functioning of the leader platform Airbnb. Moreover, the entry of temporary tourists may cause a certain neglect in the care of the house and common areas of the building subjected to Horizontal Property Regime, and even, a disrespectful treatment to other neighbors. At rhis point it becomes necessary an analysis of jurisprudential pronouncements on the scope of the private property right (regulated in art. 33.1 of Spanish Constitution), as well as its possible conjugation with the tourist apartment restrictions in favor of co-owners' coexistence and well-being in the building.
