Abstract

Resumo O artigo discute a nocividade da mentira no debate político, apontando, contudo, ser inviável e inoportuno que o controle de conteúdo das propagandas eleitorais seja realizado pela Justiça Eleitoral. Assim, respeitando o princípio da subsidiariedade do controle judicial, apresenta uma alternativa de autoproteção coletiva que vem sendo colocada em prática nos Estados Unidos nos últimos anos, denominada fact-checking. Após explanar as principais caracterís-ticas e o funcionamento desta atividade, traça as alterações que seriam necessárias para sua transposição à realidade brasileira. Palavras-chave: Fact-Checking – Propaganda Eleitoral – controle judicial Abstract The article discusses the negative effects lies bring to the political debate, pointing, however, to be impractical and inappropriate for the election advertising content control to be carried out by the Electoral Justice. Thus respecting the subsidiarity principle of judicial review, presents an alternative of collective self-protection that has been put into practice in the United States in recent years, called fact-checking. After explaining the main features and the operation of this activity, traces the changes that would be needed to transpose it to the Brazilian reality.
