Effective conflict resolution in administrative proceedings in Slovenia: A theoretical and empirical analysis

Abstract

Slovene administrative regulation is considered as one of the most successful in the postsocialist states. As proven by empirical and comparative analysis, the effectiveness of legal remedies system is undeniable. Individual administrative acts can be challenged by a mandatory administrative appeal or further action before the Administrative Court. Simultaneously, parties can search for the ombudsman’s help to act as a mediator between them and administrative authorities. As examined in the research based on annual reports and surveys in selected fields—taxes, building permits, social insurance—in 2007–2011 the most effective ADR tool in Slovenia was the internal administrative appeal. Data reveal effective dispute settling within administrative procedure, with the exception of selected areas where there is still a rather long decision-making process. This and the still underdeveloped mediation tools are areas that need further improvements.
