Abstract

Federal and state law both play a role in educating a child with a disability. This chapter will provide a very general overview of federal law, including Section 504 of the American’s with Disabilities Act (a.k.a., Section 504) and the Individuals with Disabilities Education Act (IDEA). The background of each law will be provided, as well as the process through which one goes to determine eligibility, and information for parents and professionals on how to advocate for the student. Please note that there is no specific discussion of the application of federal law to any particular state since variations exists among the states as a result of different state laws (This chapter is for general information purposes only and is not intended as legal advice. The reader will need to consult with their particular state’s law to access information that may be specific to that state.
