This article is a dogmatic analysis of the crimes set out in Article 286 of the Spanish Criminal Code: provision or supply of illicit access to broadcasting and interactive services, commonly piracy of such services, and alteration of telecommunications equipment. This provision is a sample of the most controversial Spanish criminal policy. The ban comes from a supranational rule of the European Parliament which was adopted by the Spanish legislature in the creation of an offense that does not accomplish with criminal law principles such as proportionality or minimal intervention.
