DAFTAR PEMILIH TETAP DAN PERLINDUNGAN HAK PILIH (KAJIAN PERUNDANG-UNDANGAN DAN KEPUTUSAN MAHKAMAH KONSTITUSI)

Abstract

Penyelenggaraan Pemilihan Umum menjadi tugas pokok dari Komisi Pemilihan Umum yang dibentuk berdasar Undang-undang Nomor 48 Tahun 2008 tentang Penyelenggara Pemilu. Pasal 2 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “kedaulatan berada di tangan rakyat dan dilaksanakan menurut Undang-Undang Dasar”. Pemikiran memberikan deskripsi hak asasi sebagai sebuah konsekwensi dari keberadaan Natural Rights manusia sebagai mahluk Tuhan. Hak-hak asasi tersebut sifatnya kodrati (natural) dalam arti kodratlah yang menciptakan dan mengilhami akal budi dan pendapat manusia; setiap orang dilahirkan dengan hak-hak tersebut; hak-hak itu dimiliki manusia dalam keadaan alamiah (state of nature) dan kemudian dibawanya dalam hidup bermasyarakat. Secara normatif, hak politik warga “hak untuk memilih” telah dijamin oleh putusan MK, namun dalam pelaksanaannya tentu masih harus dikaji secara mendalam. Pernyataan ini wajar dalam hal pemahaman warga dan petugas TPS terhadap putusan ini belum secara keseluruhan dipahami.
