The objective of this research is to demonstrate how international human rights protection organizations have contributed to the construction of mechanisms of political legitimacy, extending the scope of protection of States not only to their citizens, but also to all persons residing or transiting through their territory. This paper will demonstrate how migrants have benefited from international legal instruments for the protection of human rights, insofar as they have contributed to the consolidation of a neoconstitutional and democratic state of law in the nations that have opted for their application.
