Abstract

Post-partum syndrome is a psychological disorder experienced by mother after giving birth. The disorder varies in size but in general the mother will experience unstable emotions, irritability, even a loss of self-control. In this depressed condition a mother can commit a criminal offence. The study focuses on whether a mother suffers from postpartum depression can be held accountable to criminal and how it can be treated. This research method used was normative yuridis. The result of the study was the mother of postpartum depression who committed criminal acts and still had to undergo expert trials at the trial. If a the time of the crime he committed no crime he could be convicted. Similarly, when an expert claims that he is not trouble by an illness while committing a crime, he cannot be held accountable for it.
