Abstract

This paper seeks to investigate the increasing phenomena of child marriage in Indonesia, which necessitates a comprehensive method encompassing all interconnected stakeholders to avoid child marriage. This study aims to examine the extent of the Court’s efforts to prevent child marriage and the concept of preventing child marriage through system interconnection. This study is normative research that uses a statutory and a conceptual approach. According to the findings of this study, the Religious Courts’ efforts to prevent child marriage have focused on restricting the issuance of dispensation permissions. When awarding a marriage dispensation permit, the Court must ensure that it adheres to the guiding principles of child protection. The system interconnection-based child marriage prevention mentioned in this study refers to a strategy used by the Court to prevent child marriage that involves participation from other institutions. This new framework makes non-judicial agencies external participants in executing and supervising the Court’s competence in providing dispensation permits for marriage.
