Given the growing number of firms sued, racial harassment seems to be a growing problem in the workplace. It is important to specify that harassment standing alone is not illegal. The harassment must be based on an illegal factor, i.e.. the employer can't harass the employee because of his race , but he can harass him because he just doesn't like him. If an employer treats an employee badly due to race it is racial harassment. It it is due to sex or gender, it is sexual harassment etc, but there is no law against general harassment or bad treatment of an employee. After giving a definition of racial harassment, this article shows how it affects American companies through case studies. Finally it shows how these firms can prevent trial for racial harassment.
