SENGKETA PEMANFAATAN TANAH KAWASAN HUTAN ANTARA WARGA MASYARAKAT DENGAN DINAS KEHUTANAN THE DISPUTES OF A UTILIZATION OF THE FOREST AREA BETWEEN THE FOREST COMMUNITY AND FORESTRY SERVICE

Abstract

The aims of this study to find out and analyse background factors which is making conflict or dispute possession and utilization land forest area in Kedaro village, Lombok Barat Regency, Find out and analyse the efforts they are doing to resolve their conflict or dispute. This research is normative and empirical law. Moreover, the approach method is using in this research that is: statute approach, case approach, sociological approach. Source of data, that is primer data and secondary data. The data collection was done by interview and the collection legal material was done by documentation study and legal materials analyse by qualitative descriptive and furthermore from all these data researcher can makes conclusion. The result of this study that is (1) dispute in the Pelangan forest area Lendang Guar sub village Kedaro has been background factors that is: (a). Government policy for forest of land. (b) difference perception on juridical normative. (c), society culture. (2). The efforts and the patterns dispute resolution between parties who were in conflict in land of forest Pelangan Kedaro Village have settlement through litigation and non litigation.
