Abstract
The article focuses on the imbalance between privacy protection and law enforcement in the U.S. due to the rise of the global positioning system (GPS). It says that warrantless tracking is a violation of the Fourth Amendment rights and the use of GPS tracking device is an abuse of governmental power. Furthermore, it mentions the totality of the information (TOI) theory by the D.C. Circuit, which can help the police and the courts in determining whether an activity needs a warrant.
