PERLINDUNGAN HUKUM ATAS PEMBELI TIKET SEPAKBOLA MELALUI SITUS RESMI ONLINE SAAT PERTANDINGAN SEPAKBOLA DIBATALKAN OLEH PIHAK YANG BERWENANG ATAS DASAR PERTIMBANGAN KEAMANAN

Abstract

Sepakbola merupakan salah satu cabang olah raga yang memiliki penggemar sangat banyak jumlahnya. Penjualan tiket pertandingan sepakbola dilakukan dengan cara online, hal ini memang bertujuan baik, karena dengan penjualan online, berdesakan antrian di loket yang dapat menyebabkan cidera pengunjung itu dapat terhindarkan. Kendati demikian, supporter sepakbola masih sering bertindak sesuka hati dengan cara membobol dan memaksa masuk, stadion, dan juga dengan perbuatan-perbuatan lain yang cenderung membuat rawan aspek keamanan. Oleh karena itu, pihak kepolisian pernah bertindak, atas ulah supporter sepakbola yang membuat rawan keamanan, itu membatalkan pertandingan secara sepihak. Pada aspek hukum, hal ini menjadi suatu permasalahan, mengingat supporter yang beritikad baik dengan membeli tiket dengan cara dan prosedur yang benar dan telah ditentukan, itu pada akhirnya merasa dirugikan atas perbuatan pembatalan tersebut. Apakah dapat pihak yang merasa dirugikan tersebut untuk mendapatkan ganti rugi, dan apakah pihak kepolisian berwenang untuk membatalkan perikatan antara pembeli tiket dengan pihak penyelenggara. Penelitian ini merupakan penelitian normatif. Hasil yang didapatkan dari penelitian ini adalah pihak yang dirugikan dengan beberapa ukuran tertentu, dapat meminta ganti rugi atas dibatalkannya pertandingan sepakbola, walaupun atas dasar pertimbangan keamanan. Football is a sport that has very many fans. Ticket sales of football matches are done online, this is indeed a good cause, because with online sales, crowded queues at counters that can cause injury to visitors can be avoided. Nevertheless, football supporters still often act as they pleased by breaking into and forcing entry, stadiums, and also with other actions that tend to make the security aspects vulnerable. Therefore, the police had acted, for security reasons, because of the actions of football supporters who made security vulnerable, it canceled the match unilaterally. In the legal aspect, this becomes a problem, bearing in mind that supporters who have a good intention to buy tickets in the manner and procedure that have been determined, in the end feel disadvantaged over the act of cancellation, whether or not the party who feel aggrieved to obtain compensation, and whether the police have the authority to cancel the agreement between the ticket buyer and the organizer. This research is a normative research with a statutory approach. The results obtained from this study are that the injured party with a certain size, can ask for compensation for the cancellation of a soccer match, even on the basis of security considerations.
