TINJAUAN YURIDIS TERHADAP PERJANJIAN JUAL BELI SECARA ONLINE PADA TOKO ONLINE MYRUBYLICIOUS DITINJAU DARI UNDANG-UNDANG NOMOR 11 TAHUN 2008 TENTANG INFORMASI DAN TRANSAKSI ELEKTRONIK

Abstract

This research was conducted in Bandung City, West Java Province, Indonesia. This study aims to describe the validity of online buying and selling transactions at myrubylicious online shop and to describe the legal protection for parties involved in buying and selling transactions online at myrubylicious online shop according to Law Number 11 of 2008 concerning Electronic Information and Transactions. The method used in this study is the normative method, which will examine the validity of online buying and selling transactions as well as legal protection for parties involved in online buying and selling transactions at the myrubylicious online shop. The data collection method in this research uses a literature study, namely by reading and studying some literature, books, and other documents to examine the problems in this research and field research to obtain primary data that is carried out by interviewing the parties involved in the myrubylicious online shop. From the results of the study, it was found that buying and selling online at the myrubylicious online shop was by Article 1320 of the Civil Code regarding the legal requirements for sale and purchase so that in this case, buying and selling online at the myrubylicious online store was considered to be legally valid. Besides, if consumers receive goods that are not by the information provided to them, the author as the owner of the myrubylicious online shop is willing to provide compensation in the form of refunds that have been paid or consumers have the right to choose other items according to the price of the goods previously ordered. This is by Article 51 paragraph (1) PP. 82 of 2012. However, in implementing the ITE Law there are still many obstacles so that the ITE Law has not been able to provide maximum legal protection for parties who feel disadvantaged, especially in terms of online buying and selling transactions.
