The National Policy on Special Education: Equitable, Inclusive and with Lifelong Learning (NSPE2020) was approved by Decree no. 10,502, of September 30, 2020, and later judged by the Direct Action of Unconstitutionality no. 6,590 of the Supreme Court. Thus, in this work, the construction process until the document is suspended is described, which was analyzed with the help of the Iramuteq software, in order to understand its constituent elements. The results allow us to conclude that the NSPE2020 is split when considering the target audience to which it is intended: a) deaf people; and b) other students of the Special Education Target Audience. The Decree was in force for about 60 days, caused controversy, was suspended but caused division in the struggle for the right to education. The construction and dissemination process illustrates the importance of the collective construction of a public policy and the involvement of society and, above all, of the people for whom such legislation is intended.
