O Acordo de Paris

Abstract

O presente artigo tem como objetivo analisar a (in)efetividade do Acordo de Paris como mecanismo para o combate às mudanças climáticas. O presente estudo se justifica pela necessidade de ampliarmos os estudos sobre a efetividade do direito na sociedade sob a perspectiva da sociologia do direito a partir da complexidade das negociações e que envolvem a busca de um consenso no âmbito da sociedade global.  Primeiramente, se analisou o caminho histórico das negociações até a formalização do Acordo de Paris. A seguir, foram analisadas as Contribuições Nacionalmente Determinadas propostas por Brasil, China, Estados Unidos e União Europeia, considerando que as Contribuições Nacionalmente Determinadas são o principal meio para se atingir as metas do Acordo de Paris. O texto parte do pensamento cosmopolita e como a teoria poderia ajudar na compreensão da importância do Acordo para humanidade. O estudo realizado é de natureza qualitativa exploratória, desenvolvido por meio de consultas documentais e bibliográficas, percorrendo fontes extraídas das organizações internacionais envolvidas diretamente com estudos do meio ambiente e mudanças climáticas. Conclui-se que as Contribuições Nacionalmente Determinadas mais recentes foram mais ambiciosas, mas ainda é necessário tornar os resultados obtidos pelos países partes de forma mais transparentesThis article aims to analyze the (in)effectiveness of the Paris Agreement as a mechanism to combat climate change. The present study is justified by the need to expand the studies on the effectiveness of law in society from the perspective of the sociology of law, based on the complexity of negotiations, which involve the search for a consensus within the scope of global society. First, the historical path of negotiations up to the formalization of the Paris Agreement was analyzed. Next, the Nationally Determined Contributions proposed by Brazil, China, the United States and the European Union were analyzed, considering that the Nationally Determined Contributions are the main means to achieve the goals of the Paris Agreement. The text starts from cosmopolitan thinking and how the theory could help in understanding the importance of the Agreement for humanity. The study carried out is of a qualitative exploratory nature, developed through documentary and bibliographic consultations, covering sources drawn from international organizations directly involved in studies of the environment and climate change. It is concluded that the most recent Nationally Determined Contributions were more ambitious, but it is still necessary to make the results obtained by the country parties more transparent.
