Uso de mercúrio na Amazônia brasileira: contaminação, problemas e legislação vigente

Abstract

The constant increase in the price of gold in the international market has stimulated, in Brazil, the resumption and growth of artisanal mercury mining and the formation of mines that generally operate illegally. The gold extraction process in this model operates with rudimentary technology and is highly dependent on mercury. The objective of this research was to analyze the current legislation and gather information about real events related to the problems generated by mercury in the illegal extraction of gold, in the Legal Amazon. The methodology used in this research was the method; as for the means, the research was bibliographical and as for the ends, qualitative. It is concluded that Brazilian legislation has gaps and the performance of responsible bodies and agents is insufficient to contain the advance of pollution and contamination by mercury in the Brazilian Amazon. It was also verified that the Brazilian legal mechanisms present a deep contradiction when establishing restrictive values ​​of the presence of mercury in the environment and, at the same time, allows the use of this metal in artisanal mining, generating an inefficient and inept preventive and inspection action of the State.O aumento constante do preço do ouro no mercado internacional estimulou, no Brasil, a retomada e crescimento da mineração artesanal do mercúrio e na formação de garimpos que operam, geralmente, de forma do ilegal. O processo de extração do ouro neste modelo opera com tecnologia rudimentar e altamente dependente do mercúrio. O objetivo dessa pesquisa foi o de analisar a legislação vigente e reunir informações sobre acontecimentos reais relacionados aos problemas gerados pelo mercúrio na extração ilegal de ouro, na Amazônia Legal. A metodologia utilizada nesta pesquisa foi a método; quanto aos meios a pesquisa foi bibliográfica e quanto aos fins, qualitativa. Conclui-se que a legislação brasileira apresenta lacunas e a atuação de órgãos e agentes responsáveis é insuficiente para conter o avanço da poluição e contaminação por mercúrio na Amazônia brasileira. Verificou-se, também, que os mecanismos legais brasileiros apresentam profunda contradição ao estabelecer valores restritivos da presença de mercúrio no meio ambiente e, ao mesmo tempo, permite o uso deste metal na mineração artesanal, gerando uma ineficiente e inepta atuação preventiva e fiscalizadora do Estado.
