Perlindungan Hukum Terhadap Perempuan dan Anak Akibat Tindak Pidana Abortus Provokatus Criminalis

Abstract

Abstrak Aborsi sudah perlu mendapat perhatian melalui pengaturan yang lebih bijak untuk menghindari praktik aborsi tidak aman dan pemenuhan hak reproduksi perempuan maupun hak asasi perempuan dan anak (janin). Legalisasi aborsi perlu diperhatikan lebih bijak tetapi bukan dalam pengertian memberikan liberalisasi aborsi sebagaimana dalam Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Pasal 75 sampai dengan Pasal 77 dan Peraturan Pemerintah (PP) Nomor 61 Tahun 2014 Tentang Kesehatan Reproduksi Pada Pasal 31 sampai dengan Pasal 39 diatur tentang diperbolehkannya aborsi dengan syarat tertentu. Meskipun aborsi secara hukum terlarang, tetapi kenyataannya aborsi masih banyak dilakukan oleh perempuan dengan berbagai alasan disebabkan peraturan dan hukum yang ada kurang akomodatif terhadap alasan-alasan yang memaksa perempuan melakukan tindakan aborsi. Although abortion is legally restricted, but the reality of abortion are still widely performed by women for various reasons caused the rules and laws that are no less accommodating toward the reasons that compel women do abortion.
