FILOSOFI KEMASLAHATAN DALAM AKSIOLOGI HUKUM ISLAM (TELAAH KITAB MAQASHID SYARIAH)

Abstract

This study aims to explore the philosophy of the value of islamic law in the study of the book of Maqashid Syariah from various sides. This study has evolved over time, making it more comprehensive to adjust to new legal events. This research uses qualitative methods with a descriptive approach to analysis. This research uses secondary data with documentation data collection techniques. The documents used in this study are eight books that study Maqashid Syariah and are supported by a collection of journals and research related to the study of Islamic legal philosophy. Data analysis techniques in this research are content analysis techniques. From this research, the results were obtained that the study of mashlahat in fact is not only limited to the study of the final purpose of Islamic law known as the concern on five important points (dharuriah khamsah), but can be reviewed in other aspects such as the source of mashlahat, the core of the intended mashlahat, the scope of mashlahat, the object to be subject to mashlahat, the source of the proposition to get mashlahat and time to get mashlahat.
