Abstract

The law has been compelled to resolve for approximately 30 years the conflicts that arise when subjects conceived by heterologous dona-tion express their intention to know their genetic origins. The competing rights require a balancing test between the right to know the genetic origin of the one conceived through assisted reproductive technology and the right to reserve for heterologous donors. This article tries to answer questions such as: what happens to the right to identity of children born using Heterologous Assisted Human Reproduction Techniques? Is their right guaranteed, protected and constitutionally recognized in all cases? How should the judicial operator proceed when the right to know the genetic origin is disputed with the right to anonymity of heterologous donors? The foregoing cannot be resolved without studying, from the comparative law, how this right to know has been built, also the regulatory trends in contrast to the anonymity of donors and the legal solu-tions in force in other jurisdictions such as Europe, the United States and Latin America, in order to propose the most equitable solution for the Colombian case.El derecho se ha visto compelido a resolver desde aproximadamente 30 años los conflictos que surgen cuando los sujetos concebidos por donación heteróloga exteriorizan su intención de conocer sus orígenes genéticos. Los derechos en pugna requieren una prueba de ponderación entre el derecho a conocer el origen genético del concebido mediante TRHA y el derecho a la reserva de los donantes heterólogos. Este artículo pretende dar respuestas a interrogantes como, ¿se podría decir que existe un derecho subjetivo a conocer la identidad genética de los niños nacidos a través el uso de Técnicas de Reproducción Humana Asistida con donante anónimo?; ¿existirán mecanismos constitucionales y legales que lo puedan reconocer y por ende proteger? ¿cómo debe proceder el operador judicial al momento que entren en disputa el derecho a conocer el origen genético con el derecho al anonimato de los donantes heterólogos? Lo anterior no puede ser resuelto sin antes hacer un recorrido desde el derecho comparado indagando como se ha ido construyendo este derecho a conocer, también las tendencias normativas en contraste con el anonimato de los donantes y las soluciones legales vigentes en otros ordenamientos como por ejemplo Europa, Estados Unidos y Latinoamérica, para así poder proponer la solución más equitativa para el caso colombiano.
