PENANGANAN TINDAK PIDANA PENCURIAN DENGAN KEKERASAN DI WILAYAH HUKUM KEPOLISIAN RESOR PANGKAJENE DAN KEPULAUAN

Abstract

Penelitian ini bertujuan menganalisis penerapan hukum terhadap pelaku tindak pidana pencurian dengan kekerasan di wilayah hukum Kepolisian Resor Pangkejene dan Kepulauan, dan mengkaji dan menganalisis faktor yang mempengaruhi penerapan hukum terhadap pelaku tindak pidana pencurian dengan kekerasan di wilayah hukum Kepolisian Resor Pangkejene dan Kepulauan. Metode penelitian yang digunakan adalah penelitian gabungan normatif dan empiris. Hasil penelitian menunjukan bahwa: Penerapan hukum terhadap pelaku tindak pidana pencurian dengan kekerasan di Kepolisian Resor Pangkejene dan Kepulauan kurang berjalan secara optimal, dikarenakan pada proses penegakan hukumnya masih ditemukan masalah. Hal ini membuat kinerja Penyidik Unit Satuan Reserse Kriminal Umum, belum berjalan secara optimal. Dan faktor yang mempengaruhi penerapan hukum terhadap pelaku tindak pidana pencurian dengan kekerasan yaitu; substansi, struktur, budaya, sumber daya penyidik yang kurang, Anggaran Yang Terbatas dan Luas Wilayah. Pada kelima faktor tersebut yang paling berpengaruh terhadap penerapan hukum terhadap pelaku tindak pidana pencurian dengan kekerasan di Unit Satuan Reserse Kriminal Umum adalah substansi hukum. This study aims to analyze the application of the law against perpetrators of violent theft in the jurisdiction of the Pangkejene and Islands Resort Police, and examine and analyze the factors that influence the application of the law against perpetrators of violent theft in the jurisdiction of the Pangkejene and Islands Resort Police. The research method used is a combined normative and empirical research. The results showed that: The application of the law against perpetrators of violent theft in the Pangkejene and Islands Resort Police is not running optimally, because in the law enforcement process there are still problems. This makes the performance of the Investigator of the General Criminal Investigation Unit, not running optimally. And the factors that influence the application of the law against perpetrators of violent theft are; substance, structure, culture, lack of investigator resources, limited budget and area. In these five factors, the most influential on the application of the law against perpetrators of violent theft in the General Criminal Investigation Unit is the substance of the law.
