Homoparental adoption under Brazilian and Italian Law

Abstract

This article aims to investigate, from a comparative perspective, the legal and jurisprudential criteria established by Brazil and Italy to adjudicate the homoparental adoption, recommending, consequently, elements of equality and inequality in the application of this institute. The main problem in this case is the absence of legal standards that ensure security and stability for the adoption.
