Nociones para la interpretación y delimitación del nuevo delito de apremios ilegítimos u otros tratos crueles, inhumanos o degradantes

Abstract

In the framework of recent reforms to the Criminal Code, both by Law No. 20,968 and Law No. 21,013, the main objective of this work is to interpret the base figure of the new crime of illegitimate constraints or other cruel, inhuman or degrading treatment, in order to contribute to delimit and clarify its typical elements, both objective and subjective. With this, the work also aims to offer a characterization and identification of the figure that allows it to be separated from other related types, mainly, of torture and ill-treatment of persons under 18, older adults and people with disabilities.En el marco de las recientes reformas realizada al Código Penal, tanto por la Ley N° 20.968 como por la Ley N° 21.013, el objetivo principal de este trabajo es interpretar la figura base del nuevo delito de apremios ilegítimos u otros tratos crueles, inhumanos o degradantes, de forma de contribuir a delimitar y aclarar sus elementos típicos, tanto objetivos como subjetivos. Con ello, el trabajo pretende ofrecer además una caracterización e identificación de la figura que permita deslindarla de otros tipos relacionados, principalmente, de la tortura y del maltrato a menores de 18 años, adultos mayores y personas en situación de discapacidad.
