TELAAH NILAI-NILAI KEKUASAAN KEHAKIMAN DALAM HADITS MUADZ BIN JABAL

Abstract

The hadith of Muadz bin Jabal is one of the most popular hadiths. This hadith discusses the sending of Muadz bin Jabal to Yemen related to the handling of cases or judges. The content in this hadith relates to the power of the judiciary. This is as stated in the conversation of the Messenger of Allah with Muadz bin Jabal. This study aims to examine the values of judicial power in the hadith of Muadz bin Jabal and their correlation with judicial power in Indonesia. This research is a literature study with a conceptual approach. The results of this study indicate the values of judicial power in the Hadith of Muadz bin Jabal. First, the decision must have legal considerations or basis. Second, Ius Curia Novit or the judge is considered the most knowledgeable about the law and third, the principle of judges may not reject cases due to the absence of law.
