Difícil hierarquia: a avaliação do Supremo Tribunal Federal pelos magistrados da base do Poder Judiciário no Brasil

Abstract

O artigo discute a imagem freqüentemente negativa do Supremo Federal Tribunal junto a parte significativa dos magistrados de primeira e segunda instâncias do Poder Judiciário no Brasil contemporâneo. O trabalho insere-se no debate sobre a sociologia das instituições judiciais brasileiras e integra, portanto, o quadro mais amplo das discussões que envolvem a sociologia do campo jurídico. Partindo de dados coletados em surveys e previamente apresentados em outros estudos, o artigo confere nova sistematização e interpretação voltada a debater o tema proposto. Como resultado, observa-se que as diferenças nas formas de recrutamento dos magistrados dos diferentes níveis hierárquicos conduzem a visões díspares com relação ao exercício da função judicial e a uma visão aparentemente estereotipada que os magistrados da base do Poder Judiciário apresentam da Suprema Corte brasileira.The article discusses the supreme federal tribunal's overall disapproval by significant parcel of the lower ranking judges in contemporary brazil. This work inserts itself into the sociological debate over Brazilian judicial institutions and integrates, therefore, the main field of law's sociology. To that end, the article takes data previously collected and published in other studies, conferring them new systematization and interpretation directly turned to address the inquiry of interest. As result, it founds that the differences in the rules of recruitment of magistrates from the distinct hierarchical levels lead to distinct understandings as for the exercise of the judicial function and, particularly, to an essentially stereotypical perspective that Brazilian judges exhibit concerning their Supreme Court.
