Legal Aspects of Using the Internet of Things (IOT) in Electronic Commerce

Abstract

Objective: The growing reliance on digital technologies in contemporary society underscores the need for a robust legal framework to ensure security. The development of the Internet of Things (IoT) introduces various threats, highlighting the challenges in effectively utilising this technology.   Background: The Internet of Things (IoT) enables electronic data exchange between remotely located objects or systems, offering numerous applications in e-commerce. However, its integration also presents legal complexities that must be addressed to ensure security and compliance.   Methodology: This study employs various research methods, including analysis and synthesis, induction and deduction, and systemic, legal, and analytical approaches to explore the legal aspects of IoT usage in e-commerce.   Contribution: The article classifies IoT applications in e-commerce into five categories: 1) smart devices, 2) object monitoring and logistics optimization, 3) consumer search query analysis on mobile devices, 4) chatbots and voice assistants, and 5) trend analysis for demand forecasting. The paper examines the challenges of implementing IoT in e-commerce, including personal data protection, cybersecurity, liability, rights protection, and the lack of standardisation. It outlines the necessary legal frameworks to address these issues, emphasizing modern legislation, security standards, and consumer education to mitigate risks.   Findings: The protection of intellectual property and copyrights in the digital age is becoming more complex, with IoT devices generating and sharing vast amounts of data. The study emphasizes that as IoT continues to integrate deeper into e-commerce operations, legal frameworks must be flexible and forward-thinking to address emerging challenges, such as data privacy, cybersecurity risks, and consumer protection.
