EL GÉNERO EN LA "VIOLENCIA AFECTIVA": CLAVE PARA UN EXAMEN DE CONSTITUCIONALIDAD

Abstract

Resumen: La violencia de género, en ocasiones, se identifica con la violencia machista en parejas en las que existe o ha existido un vínculo afectivo sentimental. En efecto, se trata de violencia de género de tipo afectivo. Sin embargo, ni la violencia afectiva o familiar puede identificarse con la violencia de género, ni ésta puede reducirse a la enmarcada en relaciones afectivas. Es imprescindible abordar la violencia desde la perspectiva de género para encontrar respuestas acertadas. La regulación de este tipo de violencia desde un derecho penal "de género" abre el debate acerca de la constitucionalidad del tratamiento penal diferenciado entre mujeres y hombres. It is essential to address violence from a gender perspective to find correct answers.
