Abstract

The article discusses the relationship between social media and electronic discovery (e-discovery) as of March 2012, focusing on a the impact of technological innovations such as the social networks Facebook and Twitter on litigation in the U.S. Personal and corporate privacy rights are addressed in relation to social media use. The American e-discovery rules in cases involving social media are analyzed, including rules regarding the preservation, collection, and disclosure of electronically-stored information.
