A proposal of legal anti-corruption measures for political parties

Abstract

It is common that political parties, considered here in their legal personality, have been involved in acts of corruption. However, since they are neither a control nor of power, they end up being ignored by the legal system at the time of the imposition of control mechanisms and sanctions. This paper addresses the issue of this legal “vacuum” on partisan organizations, focusing on a proposal just to fill this gap. It has been objectified, through a literature review, to expose different initiatives in other countries that specifically target the legal personality of the parties, reducing the incentives of their use for the practice of misappropriation of resources, legitimization of capital and other crimes, building an own proposal that could be applied in many systems. In the end it is concluded that, even if it is a private entity, the parties cannot fail to be accountable, and the anticorruption measures here exposed can strengthen the fight against corruption
