Trialism as a means to promote justice within the complexity of the digital age

Abstract

The historical scenario characterized by the acceleration of technological development -based on artificial intelligence, neuroscience and genetics- framed in the digital era, denotes the need to develop legal theories suitable: to protect citizens and their ecosystem and to adapt their pieces to the model of constitutional State. We hold that an adequate theory must analyze the complexity of life and that Law is a cultural object; consequently, we employ the trialist methodology as a tactic for the integration of the dimensions: sociological, normological and dikelogical or axiological of the legal phenomenon. To this end, we use the strategic categories -they offer us a dynamic vision- with a theoretical approach that draws on other valuable juridical and interdisciplinary contributions aimed at any of these dimensions; thus, we provide ideas that may be useful for the development of other legal theories since they evolve based on their reciprocal communication.
