Abstract
The objectives of this study aim to analyze the urgency of criminal cases spreading false and misleading news that harm consumers on social media can be resolved through mediating penalties, and (2) to analyze the principles and concepts of resolving criminal cases for spreading news lies and misleading that harm consumers in social media through mediating penalties in the future. The results of the study were obtained that the resolution of criminal cases spreading false and misleading news that harmed consumers on social media can be resolved through mediating penalties, the urgency of which is: (a) the characteristics of criminal acts have the characteristics of conflicts of individual interests between business actors and consumers resulting in losses material to consumers; (b) encourage and strengthen the position or involvement of consumers as victims in fighting for their rights to obtain compensation, and (c) allowing the perpetrators to take corrective actions as a form of responsibility for their mistakes to the consumers. Besides, the settlement of criminal cases spreading false and misleading news that harms consumers on social media through the mediation of penalties prioritizes principles, namely (a) victims are directly involved in the process to achieve satisfying results; (b) the perpetrator is aware of the consequences of his actions towards others and is responsible for what he does; (c) repairs to losses more quickly, taking into account the wishes of victims and perpetrators; and (d) victims and perpetrators directly end problems that occur.
