PENGEMBANGAN MODEL ALTERNATIF MENANGANI ANAK YANG BERHADAPAN DENGAN HUKUM BERBASIS MASYARAKAT DI KELURAHAN CIPINANG BESAR UTARA, JAKARTA TIMUR

Abstract

Undang- undang No.11 tahun 2012 tentang Sistem Peradilan Pidana Anak diberlakukan tahun 2014. Hal ini memberikan peluang besar dilakukannya diversi, sehingga peran serta masyarakat sangatlah penting dalam menangani anak yang berhadapan dengan hukum (ABH). Penelitian ini mengembangkan suatu model berbasis masyarakat di Kelurahan Cipinang Besar Utara, Jakarta Timur. Metode penelitian yang digunakan adalah kualitatif melalui action research. Ada tiga tahapan penelitian yaitu tahap look, think danact. Sifat penanganan yang dikembangkan ada dua antara lain pencegahan (preventive) dan pemulihan (rehabilitative). Hasil penelitian ini memperlihatkan ada empat program yang dikembangkan antara lain: 1) sosialisasi kepada masyarakat dan anak, 2) manajemen kasus dan pemberian bantuan sosial anak, 3) membangun kelompok dukungan keluarga, dan 4) membangun kelompok dukungan sebaya. Proses penanganan berbasis masyarakat (community based) yaitu dilakukan dengan terencana, hal ini untuk memfasilitasi dan mengembangkan kapasitas individu, kelompok dan masyarakat guna merespon masalahmasalah yang ada. Pengembangan masyarakat sebagai strategi proses perubahan yang sistemik, terencana dan membebaskan kelompok yang puas dengan diri sendiri (pasrah), kehilangan atau mengalami deprivasi, penuh ketakutan serta kemiskinan, kedalam kondisi masyarakat yang teratur penuh kesadaran, memiliki keberdayaan, penuh percaya diri, adil dan manusiawi. This provides a great opportunity to do diversion, so that community have bigger chances to participate on dealing with children in conflict with the law (ABH). This study develops a model which community based in Cipinang Besar Utara, East Jakarta. The research uses qualitative method through action research. There are three stages of research, namely the stage look, think and act. In terms of handling the problem, it has developed two kinds of model that’s called preventive and rehabilitative. This study shows there are four programs developed include: 1). dissemination an information to the public and children, 2). case management and provision of social aid children, 3). build up a family support group, and 4). build up a peer support group. The process of community-based treatment that is carried out has well planned, to facilitate and develop the capacity of individuals, groups and communities to respond to the problems that exist. Community development as a strategy for systemic change process, planned and relieving a group who are satisfied with themselves, lose or suffer deprivation, full of fear and poverty, into the condition of the people who regularly full consciousness, having empowerment, confidence, fair and humane.
