Abstract

The following reflection is the result of a large doctrinalanalysis, which demonstrates the current Europeanlegislation and the foreign immigration is very severe.However, this is measures that both violate humanrights, are regarded as socially necessary by the «risk»that immigration poses to democracy.This study focuses on the policy of integration of foreignersin Spain; similarly the so-called policy of integratingforeigners that is a failure and consists ofhidden racism and xenophobia on first place and foremostit comes from the state, which shows that thelegislation has to do with the negative effects of immigrationrather than its causes.
