Abstract

This article questions the classification of Mexico as a case of successful institutionalization of LGBT rights, demonstrating that the recognition of these rights is the exception and not the rule that prevails at the subnational level. It is argued that in spite of the obstacles generated by the federal model, the consolidation of an extended collective field of action throughout the nation has been a fundamental factor in driving the demands for the recognition of the rights of sexual minorities. Appealing to a repertory of demands such as strategic litigation, collective action has made visible the condition of unconstitutional items and legal discrimination of the LGBT population that prevails in the majority of the states of Mexico.
