Abstract

In the contemporary era, digitalization has become an integral part of daily life, offering unprecedented connectivity through platforms such as WhatsApp, Facebook, YouTube, and various other social media outlets. However, this digital revolution has also given rise to significant challenges, with cybercrime emerging as a global concern. The ubiquity of these platforms, which collectively boast over two billion active users worldwide, has made it increasingly difficult to avoid the risks associated with cybercriminal activity. Cybercrime a worldwide problem, India not an exception to this, but illiteracy, poverty, lack of awareness worsens it more in India  India faces an urgent need for enhanced cybersecurity measures, as the country continues to lack comprehensive legislation to address cybercrimes effectively. This gap in legal protections exacerbates vulnerabilities, particularly for women, children, and senior citizens. Issues such as child pornography, online frauds via matrimonial sites, and the theft of sensitive data are widespread. Furthermore, once data is shared on digital platforms like WhatsApp or Facebook, it cannot be fully deleted, highlighting the need for regulations like the "Right to be Forgotten," as recognized in Europe. While India’s Information Technology Act, 2000 provides some legal framework, it is insufficient to address the evolving and increasingly sophisticated nature of cybercrime. This paper calls for the development of a robust legal framework to combat cybercrime, emphasizing the necessity of stricter regulation in the digital age.
