Abstract

The present work aims to provide tools to operate in mixed systems of assessment of evidence. It is a question of verifying how is it possible to make compatible an assessment system that, along with predisposing the result of certain means of proof, refers to the judge's self-assessment the evidential results of the other means. For this context, it has been postulated the thesis that the norms of legal evidence constitute simply presumptive legal norms and, ultimately, the burden of proof. The author, along with disposing of the forms of defeasibility of the norms of legal evidence, places its work in the instrumental proof under the context of the reform of the Chilean civil procedure, which, along with the assessment of the evidence according to the sana crítica, establishes legal evidence norms for recognized public and private instruments.
