COMPARISON OF LAWS OF PATIENTS OF MALPRATICE PLASTIC SURGERY IN INDONESIA AND SOUTH KOREA

Abstract

Adolescents to old age in modern times are increasingly showing their interest in the world of beauty, nowadays the world of beauty is growing rapidly. The world of beauty has a function in the health sector, for example in reconstruction such as burn cases, facial trauma in cases of accidents, congenital defects (congetinal) and others. Therefore, many people who flock to plastic surgery because they are tempted by the many promising advertisements. the higher the rate of plastic surgery, it cannot be denied that there will be cases of malpractice. This study aims to determine and analyze legal protection and prevention of plastic surgery malpractice crimes currently in effect. This research is useful theoretically and practically with regard to consumer protection in the field of plastic surgery malpractice. This type of research is the normative juridical research. Analysis of legal materials used using qualitative analysis by describing descriptively analytical and prescriptive. Based on research, the form of legal protection against plastic surgery malpractice in Indonesia is regulated in the Law on Consumer Protection in general and the Law on health and medicine in particular. In Korea, it is regulated in the South Korean Constitution which contains security in terms of malpractice. Every country experiences different cases of malpractice, as well as different ways of dealing with them. Each country only needs to pay attention to the legal protection system that is implemented so as to provide a deterrent effect on plastic surgery malpractices that are not in accordance with national standards and also provide sufficient direction and guidance to the community in order to understand how to reduce the risk of dangerous malpractices that occur.
