Abstract

Over the last decade, the emerging trend in China to regard environmental justice as a separate and distinct body of law, from an objective perspective, has been facilitating ecological protection and the sustainable development of resources and energy. However, the current judicial approaches to environmental justice in China, compared with other countries, are yet to break away from the traditional judicial boundary. It is concluded that China should continue to deepen its environmental judicial reform in terms of cross-administrative division management, expert involvement, scope of authority and judicial philosophy, and also for this purpose, the paper advises to set up specialized environment courts.
