Abstract

This article pretends to make a socio-juridical analysis regarding the women's and children's access to their right to land, specifically on the application of the Victims and Land restitution Law. it seeks to prove that even thought it exist a wide and protective normative in favor of this populations, to State's institutions to charge of the land issues are uncapable to recognize the sociological reality of displaced families in its public policies procedures and consequently, women and children are excluded of the mechanisms for accessing effective enjoyment of their rights. This happens as long as State has an anacronical notion of family and incongrous with peasant reality, model in which family is a hierarchical group in which men is the leader and women and children are some kind of help.
