Abstract

This article aims to make a rational reconstruction of the narrow use of the concept of constitutional social rights. It states the hypothesis that constitutional social rights in a narrow sense are subjective rights that enjoys constitutional status, whose structure is composed of: a holder "a", which represents an individual person; a recipient "b", which can be as both the State and private natural or legal persons, and an object "Apf", that symbolizes a factual positive action.
